Terms of Service

1. Acceptance of Terms

By downloading or using LocaCheck (the "App"), you agree to be bound by these Terms of Service ("Terms") and our Privacy Policy. If you do not agree, do not use the App.

2. Description of Service

LocaCheck offers two main features: (1) informational safety tools that help you assess the potential risk of unknown phone numbers, text messages, and web links; and (2) an optional location-sharing feature that lets you share your real-time location with family and friends you invite, and see theirs on a map.

    Informational purpose only. The safety-check tools do not verify the identity of any individual and do not make decisions for you. Results are estimates that help you decide, on your own, how to respond to an unknown contact.
  

3. Not a Consumer Reporting Agency (FCRA)

    LocaCheck does not provide "consumer reports" and is not a "consumer reporting agency" as defined by the U.S. Fair Credit Reporting Act (15 U.S.C. § 1681 et seq., "FCRA"). You agree that you will not use the App or any information obtained through it, in whole or in part, as a factor in establishing any person's eligibility for:
    credit or insurance;
employment, promotion, reassignment, or retention;
housing or tenancy (renting or leasing);
a government license or benefit; or
any other purpose covered by the FCRA or any similar state or foreign law.

    Similar restrictions may apply under laws in your jurisdiction; you are responsible for complying with all of them.
  

4. Eligibility

To buy a subscription or other purchase, or to enter into these Terms as a binding agreement, you must be at least 18 years old or the age of majority in your jurisdiction. A minor may use the App, including location sharing within a family, only if a parent or guardian sets it up, supervises that use, and agrees to these Terms on the minor's behalf and is responsible for any purchases. By using the App you represent that you meet these requirements.

5. Acceptable Use and Prohibited Conduct

You agree that you will not use the App to:

stalk, harass, threaten, intimidate, defame, or harm any person;
identify, locate, or contact a person against their will, or otherwise invade anyone's privacy;
track or monitor the location of any person without their knowledge and explicit consent, or induce anyone to share their location through deception or coercion;
make FCRA-regulated decisions as described in Section 3;
violate any applicable law, including anti-stalking, telemarketing, data-protection, and telecommunications laws;
reverse-engineer, decompile, scrape, or build a competing database from the App's data;
use automated tools, bots, or scripts to access the service or perform bulk lookups; or
resell, sublicense, or commercially exploit the App or its results without our written permission.

    You are solely responsible for how you use any information the App provides. You agree to use it lawfully and ethically, and to independently verify anything before acting on it.
  

6. Location Sharing

Location sharing is an optional feature based on mutual consent:

Sharing is off by default and starts only after you and another person connect using an invite code. Each person must take an explicit action to connect.
You may pause sharing at any time, and you may remove a friend at any time, which immediately stops sharing for both of you.
You are responsible for whom you invite and share your location with, and for only inviting people you trust. Only share your invite code with people you trust.
You must not use location sharing to track anyone without their knowledge and explicit consent. If a minor is involved, a parent or guardian must set up and supervise the sharing.
Location information depends on your device, GPS, and network conditions and may be delayed or inaccurate. We do not guarantee its accuracy or availability, and it must not be relied on for emergencies.

    You are solely responsible for your decision to share your location and with whom. LocaCheck is not liable for any consequences arising from your choice to share your location with another person.
  

7. User-Submitted Reports

You may choose to report or label numbers, messages, or links. By submitting a report you confirm it is accurate to the best of your knowledge and does not contain unlawful content, and you grant us a non-exclusive, worldwide, royalty-free license to use, store, and incorporate that report into our risk database to improve the service for all users. Do not submit anyone's sensitive personal information.

8. Accuracy Disclaimer

    Information is compiled from public and user-reported sources and automated analysis. It may be inaccurate, incomplete, or out of date. A "low risk" or "verified" result is not a guarantee of safety or legitimacy, and a "high risk" result is not a definitive statement that a number, message, or sender is fraudulent or that any person has done anything wrong. Results are provided "as is" for your reference only.
  

9. Subscriptions, Purchases, and Renewals

Core features of the App are free. Certain premium features are available through optional paid plans:

Auto-renewing subscriptions — billed weekly or yearly. A subscription may include an introductory free or discounted trial; unless you cancel, the subscription automatically renews at the standard price at the end of each period.
Lifetime access — a one-time purchase with no recurring charges.

The App contains no advertising. Prices are shown in the App before you buy and may vary by region and over time.

Billing and auto-renewal. Payment is charged to your Apple ID account upon confirmation of purchase. An auto-renewing subscription renews automatically unless you turn off auto-renew at least 24 hours before the end of the current period, and your account is charged for renewal within the 24 hours before the period ends. If you purchase a subscription while a free trial is active, any unused portion of the trial is forfeited.

Managing and canceling. You can manage or cancel a subscription and turn off auto-renewal at any time in your App Store account settings. Uninstalling the App does not cancel a subscription.

Refunds. All purchases are processed by Apple, and refunds are handled by Apple in accordance with its policies; we do not process payments or issue refunds directly. Except where required by law, payments are non-refundable.

10. Intellectual Property

The App, its design, software, and databases are owned by us or our licensors and are protected by intellectual-property laws. Except for the limited right to use the App under these Terms, no rights are granted to you. You may not copy, modify, distribute, or create derivative works without our prior written consent.

11. Third-Party Services

The App relies on third-party services and data sources. We do not control and are not responsible for the accuracy, availability, or practices of these third parties. Your use of app-store services is also subject to their terms.

12. Disclaimer of Warranties

THE APP AND ALL RESULTS ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. We do not warrant that the App will be uninterrupted, error-free, or that results will be accurate or reliable.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss arising from: (a) your reliance on any result; (b) any action you take or fail to take toward any person or business based on the App; (c) inaccuracy of data; or (d) service interruptions.

14. Indemnification

You agree to indemnify and hold us harmless from any claims, damages, or expenses (including reasonable legal fees) arising from your use of the App, your violation of these Terms, or your violation of any law or the rights of a third party — including any misuse of information obtained through the App.

15. Termination

We may suspend or terminate your access at any time if you violate these Terms or misuse the App. You may stop using the App at any time by uninstalling it.

16. Governing Law and Disputes

These Terms are governed by the laws of the jurisdiction in which the App's operator is established, without regard to conflict-of-law rules. Nothing in these Terms limits any mandatory consumer rights you have under the laws of your country of residence.

17. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes through an in-app notice or by updating the "Last updated" date. Continued use after changes constitutes acceptance.
